Welcome to HK SafeKids. These Terms of Service (“Terms”) govern your access to and use of the HK SafeKids website, platform, and related services (collectively, the “Platform”). The Platform is operated by HK SafeKids (“Company”, “we”, “us”, or “our”).

By registering for or using the Platform, you (“User”, “you”) agree to be legally bound by these Terms. If you do not agree, you may not access or use the Platform.

1. Introduction & Purpose

1.1 HK SafeKids provides a digital ecosystem designed to support domestic helpers, families (parents/employers), and agencies through structured training, care planning, reporting, and professional development tools. Our goal is to improve safety, professionalism, and communication in the domestic work sector.

1.2 No Employment Agency. The Platform is an enabling service only. We are not an employment agency and we do not employ helpers. We are a technology platform that provides tools for training, scheduling, and communication.

1.2.1 Employment relationships, contracts, wages, working hours, accommodation, and all other legal obligations remain solely between the helper and the family/agency.

1.2.2 HK SafeKids is not a party to any employment contract and has no control over the quality, safety, or legality of any job posting, the truth or accuracy of any user content, or the ability of any user to perform their obligations.

2. Definitions

“Helper”: An individual providing or seeking to provide care or domestic services who uses the Platform.
“Parent / Family”: An individual or household using the Platform to manage care for children or dependents.
“Agency”: An organisation that manages domestic helpers and/or facilitates placements between families and helpers on the Platform.
“User”: Any Helper, Parent/Family, or Agency.
“Content”: Any information, text, graphics, photos, profiles, reports, messages, or other materials you submit, post, or display on or via the Platform.
“Professional Passport”: A helper’s public‑facing profile containing information they choose to share, including experience, skills, and certifications.
“Certification Framework”: Our three‑dimensional credentialing system (Operational, Developmental, and Specialist Care) which helpers can earn to demonstrate expertise.

3. Eligibility & Accounts

3.1 Age Requirement. You must be at least 18 years old to use the Platform.
3.2 Account Registration. To access certain features, you must register for an account.
3.2.1 You may use a nickname or pseudonym; a legal name is not required for basic Platform usage, except as specified in Section 4.5 for payment processing.
3.2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2.3 You agree to provide accurate, current, and complete information where legally required (e.g., for tax or payroll purposes integrated into the Platform) and to update such information to keep it accurate.
3.3 Accuracy and Honesty. You represent and warrant that all information you provide is truthful and accurate. Impersonation of another person or entity is strictly prohibited.
3.4 No Agency Impersonation. Agencies are prohibited from registering on the Platform as Employers or as Helpers without our prior written permission, establishing contact with Helpers outside the Platform’s intended channels, fully or partially recovering the database from the Platform, or using the Platform for any purpose inconsistent with these Terms.

4. Data Control, Privacy & User Content

4.1 Your Control. You control the data you enter. Our Privacy Policy explains in detail what we collect, why, and how to manage it.
4.2 Family Data – Privacy Protections.
4.2.1 Parents control all information about their family and children. No real name, exact birth date, or month of birth is required for children or elderly persons. Parents may use character names, nicknames, or pseudonyms.
4.2.2 Only the year of birth is required for age‑appropriate report forms (infant, toddler, school‑age, teen, elderly).
4.2.3 Medical and special needs information is entirely optional. If such information is not shared, helpers will not receive it, and HK SafeKids disclaims all liability for any consequences arising from the non‑disclosure of this information.
4.2.4 Helpers receive only what parents choose to share.
4.3 Helper Data. Helpers control their own professional information. Helpers decide what personal details, qualifications, employment history, and references to include in their Professional Passport. Information shared with families is limited to what helpers voluntarily provide. Helpers may update or remove their information at any time, subject to legitimate business record retention (e.g., transaction history, training records).
4.4 Agency Data. Agencies control the information they provide about their organisation and the helpers they manage. Agencies are responsible for obtaining necessary consents before sharing helper data with families.
4.5 Real Names Required Only for Payments. The only circumstance where a real legal name is required is when making or receiving payments through the Platform via our third‑party payment processor, Stripe. For payment gateway compliance (anti‑fraud, know‑your‑customer), the name on the payment method must match the user’s legal name. For all other Platform features (profiles, care reports, communications, passports), real names are optional.
4.6 Parental Responsibility. HK SafeKids is not a substitute for parental responsibility. Using the Platform does not transfer or limit parents’ legal responsibilities for the care, safety, supervision, medical decisions, or welfare of their children. Parents must authorise and train helpers for any delegated tasks.
4.7 Data Security & Payments. We do not sell personal data. Payments are processed by Stripe, a PCI‑compliant third‑party processor; we do not store credit card information on our servers.
4.8 Content License. By uploading Content, you grant HK SafeKids a worldwide, royalty‑free, non‑exclusive licence to host, store, reproduce, modify (for formatting purposes), and display that Content solely to provide and improve the Platform. You retain all ownership rights to your Content.

5. User Responsibilities & Conduct

5.1 All Users must: Use the Platform lawfully, respectfully, and in good faith. Not harass, bully, threaten, impersonate, discriminate against, exploit, or harm any person. Not post, upload, or transmit any illegal, defamatory, obscene, pornographic, or otherwise offensive Content. Not attempt to gain unauthorised access to another user’s account or Company systems. Not use the Platform to spam, phish, or distribute malware. Not scrape, crawl, reverse engineer, or use any automated means to access the Platform or extract data without our prior written consent.
5.2 Parents / Families must: Provide accurate and sufficient safety and medical information to helpers when necessary for safe care. Treat helpers with dignity and respect and comply with all applicable employment laws regarding rest, meals, accommodation, wages, and working hours. Not require unlawful hours, withhold wages, or create abusive conditions. Ensure helpers are properly authorised and trained before delegating medical or technical tasks. Acknowledge that HK SafeKids is a tool and that ultimate parental responsibility remains theirs.
5.3 Helpers must: Provide accurate information about qualifications, experience, and availability. Perform duties lawfully and within their training and any delegations given. Respect family privacy and not disclose confidential family information outside the Platform without permission.
5.4 Agencies must: Ensure helpers they register are authorised to work and that all information provided is accurate and verified. Obtain all necessary consents before sharing helper data with families. Comply with all applicable agency licensing and employment laws. Not facilitate or conceal any exploitative or unlawful practices.

6. Zero Tolerance Policy for Abuse and Exploitation

6.1 HK SafeKids has a zero‑tolerance policy for abuse, exploitation, harassment, threats, or any conditions that endanger helpers or any other users of the Platform.
6.2 Prohibited Conduct includes, but is not limited to: Verbal, physical, or written threats or harassment. Wage theft, underpayment, or illegal withholding of wages. Provision of unsafe or unlawful accommodation. Requiring work hours that violate applicable employment laws. Any form of human trafficking or forced labour.
6.3 Reporting and Enforcement. Users may report suspected abuse or violations via the Platform’s reporting tools or by contacting us at info@hksafekids.com. If we receive a credible report or obtain evidence of such misuse, we may, in our sole discretion and without liability, immediately suspend or terminate the offending User’s account. We may preserve and disclose relevant logs and data to appropriate law enforcement or regulatory authorities in response to lawful requests or to protect the safety of our community. For urgent or criminal activity, we encourage users to contact local emergency services first, then notify HK SafeKids.

7. Fees, Payments, Subscriptions & Refunds

7.1 Fees and Subscriptions. Certain features of the Platform, such as the Helper Pro Plan, Family Plan, and Agency Plans, require payment of fees. All fees, subscription terms, and billing cycles are clearly displayed on the Platform’s pricing page. Subscriptions automatically renew until cancelled in accordance with the terms presented at checkout.
7.2 Payment Processing. All payments are securely processed by Stripe. By providing payment information, you represent that you are authorised to use the payment method and authorise us (via Stripe) to charge your chosen payment method for the total amount of your purchase or subscription.
7.3 Price Changes. We reserve the right to change our fees or subscription plans at any time. We will provide users with prior notice of any material changes to fees. Your continued use of the Platform after the fee change becomes effective constitutes your agreement to pay the changed amount.
7.4 Cancellation and No Refunds. You may cancel your subscription at any time via your account settings or by contacting us. Cancellation will take effect at the end of the current billing cycle (i.e., you will retain access until the end of the period you have already paid for). All fees paid are non‑refundable, except as required by applicable law (e.g., statutory cooling‑off periods or mandatory consumer protections). We do not provide refunds for partially used subscription periods, unused features, or change of mind. Unpaid fees may result in the immediate suspension or termination of your account and access to the Platform.
7.5 No Payment Transfers. Payments are strictly between the paying user (Helper, Parent, or Agency) and HK SafeKids. We do not facilitate the transfer of wages or other payments between families and helpers.

8. Verification & Screening

8.1 User Responsibility. Agencies and parents are solely responsible for verifying a helper’s identity, right to work, qualifications, and references before hiring or engaging their services.
8.2 Platform Features. HK SafeKids may, from time to time, offer optional verification features (e.g., ID verification, reference checking). Use of such features is subject to additional terms. Confirmation and the adequacy of any checks remain the sole responsibility of the hiring party. HK SafeKids makes no representations or warranties regarding the accuracy or completeness of any verified information.
8.3 No Guarantee of Verification. We do not verify listings, guarantee outcomes, or intervene in employment processes. All Content is user‑generated, and users are responsible for ensuring that any communication, listings shared by users, or arrangements comply with local labour and immigration regulations.

9. Intellectual Property

9.1 Platform Ownership. The Platform, including its software, text, graphics, logos, and the Certification Framework, is owned by HK SafeKids (or its licensors) and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without our prior written consent.
9.2 User Content Ownership. You retain all ownership rights to your Content. You grant us the licence set forth in Section 4.8 to use it.
9.3 Feedback. If you provide us with any suggestions, ideas, or feedback regarding the Platform, you grant us the right to use such feedback without any restriction or compensation to you.

10. Termination & Suspension

10.1 By User. You may delete your account or stop using the Platform at any time by following the instructions in your account settings or by contacting us.
10.2 By Company. We may suspend or terminate your access to the Platform, or delete your account, at any time for any reason, including but not limited to a breach of these Terms, illegal activity, or to protect other users. We will endeavour to provide you with notice unless we believe, in our sole discretion, that doing so would violate the law or cause harm to users or the Platform.
10.3 Effect of Termination. Upon termination, your right to access the Platform ceases immediately. We will delete your personal data within 90 days, except where we are required by law to retain it (e.g., transaction records for 7 years, logs for safety investigations). We may retain aggregated or anonymised data for analytical purposes.

11. Disclaimers and Limitation of Liability

11.1 No Professional Advice. The Platform, including all Content, training materials, care standards, task suggestions, and any other information provided, is for informational and organisational purposes only. Nothing on the Platform constitutes professional medical, legal, childcare, safety, or any other professional advice. You should consult qualified professionals for such advice.
11.2 Use at Your Own Risk. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. HK SAFEKIDS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR‑FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
11.3 Parental Responsibility and Supervision. Parents and legal guardians remain solely and fully responsible for: (a) the safety, welfare, and supervision of their children and any elderly or dependent persons in their care; (b) overseeing and monitoring how any domestic helper or third party uses information obtained from the Platform; (c) exercising their own judgment and due diligence before relying on any content or recommendations on the Platform; (d) all decisions and actions taken based on information from the Platform.
11.4 Helper Responsibility and Verification. Domestic helpers using the Platform acknowledge and agree that: (a) all training materials and care standards are guidelines only and do not replace professional training or qualifications; (b) helpers remain fully responsible for their own conduct, performance, and compliance with all applicable laws and employment obligations; (c) HK SafeKids does not verify, warrant, or guarantee the competence, suitability, or reliability of any helper or employer; (d) “Certification” on the Platform is based on employer verification of observed workplace competency and does not constitute any form of professional licence or legal qualification.
11.5 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HK SAFEKIDS (INCLUDING ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (i) YOUR USE OR INABILITY TO USE THE PLATFORM; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (iii) ANY CONTENT OBTAINED FROM THE PLATFORM; OR (iv) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. WITHOUT LIMITING THE FOREGOING, HK SAFEKIDS EXPRESSLY DISCLAIMS ANY LIABILITY FOR: (a) ANY HARM, INJURY, LOSS, OR DAMAGE TO ANY CHILD, ELDERLY PERSON, HELPER, OR ANY OTHER PERSON ARISING FROM OR RELATING TO THE USE OF THE PLATFORM; (b) ANY FAILURE OF A HELPER TO PROPERLY APPLY TRAINING MATERIALS, TASKS, OR CARE STANDARDS; (c) ANY DISPUTE BETWEEN EMPLOYER AND HELPER ARISING FROM PERFORMANCE OR NON‑PERFORMANCE OF ANY TASK OR DUTY; (d) ANY MISCOMMUNICATION, MISUNDERSTANDING, OR ERROR RESULTING FROM USE OF THE PLATFORM. NOTHING IN THIS CLAUSE LIMITS LIABILITY FOR DEATH, PERSONAL INJURY, FRAUD, OR WILFUL MISCONDUCT.
11.6 Cap on Liability. IN ANY EVENT, HK SAFEKIDS’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO HK SAFEKIDS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR HKD 1,000.00, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless HK SafeKids, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from: (i) your use of the Platform; (ii) your violation of these Terms; (iii) your violation of any third‑party right, including any intellectual property or privacy right; or (iv) any Content you post or upload.

13. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, epidemics, pandemics, power outages, internet service provider failures, or actions of any government or regulatory body.

14. Electronic Communications

You consent to receive communications from us electronically (via email, SMS, or through the Platform). You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

15. Modification of Services and Terms

15.1 Evolving Services. HK SafeKids is constantly innovating and improving its services. We reserve the right to modify, suspend, or discontinue, temporarily or permanently, any part of the Platform, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance.
15.2 Changes to Terms. We may revise these Terms from time to time. If we make material changes, we will notify you by email (sent to the email address in your account) or by posting a notice on the Platform prior to the change becoming effective. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Platform.

16. Governing Law & Dispute Resolution

16.1 Governing Law. These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles.
16.2 Dispute Resolution – Small Claims Exception. Either party may bring a claim in the Small Claims Tribunal of Hong Kong (or, for users residing outside Hong Kong, the equivalent small claims court in their country of residence) for disputes where the claimed amount does not exceed the jurisdictional limit of that small claims court (typically HKD 75,000 in Hong Kong). Any dispute not resolved in small claims shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the notice of arbitration is submitted. The seat of the arbitration shall be Hong Kong. The language of the arbitration shall be English.
16.3 Regional Applicability. These Terms apply to all users regardless of their location. Users are responsible for complying with their local laws. Nothing in this Section 16 shall prevent either party from seeking interim injunctive relief from any court of competent jurisdiction.

17. General Provisions

17.1 Entire Agreement. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and HK SafeKids regarding your use of the Platform.
17.2 Severability. If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
17.3 Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
17.4 Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.

1. 引言及目的

1.2 非職業介紹所。 平台僅屬輔助服務。我們並非職業介紹所,亦不僱用傭工。我們是一個提供培訓、日程安排及溝通工具的科技平台。

1.2.1 僱傭關係、合約、工資、工作時間、住宿及所有其他法律義務仍僅屬傭工與家庭/機構之間的事宜。

1.2.2 HK SafeKids 並非任何僱傭合約的當事方,對任何職位空缺的質量、安全性或合法性、任何使用者內容的真實性或準確性,或任何使用者履行其義務的能力概無控制權。

2. 定義

「家庭傭工」:使用平台提供或尋求提供護理或家務服務的個人。
「父母/家庭」:使用平台管理子女或受養人照顧的個人或家庭。
「機構」:管理家庭傭工及/或在家庭與傭工之間促成配對的組織。
「使用者」:任何家庭傭工、父母/家庭或機構。
「內容」:您提交、張貼或顯示在平台上或通過平台提交的任何資訊、文字、圖形、照片、個人檔案、報告、訊息或其他材料。
「專業護照」:家庭傭工的公開個人檔案,包含他們選擇分享的資訊,包括經驗、技能及認證。
「認證框架」:我們的三維認證系統(營運、發展及專科護理),家庭傭工可藉此展示專業知識。

3. 資格及帳戶

3.1 年齡要求。 您必須年滿 18 歲方可使用平台。
3.2 帳戶註冊。 要使用某些功能,您必須註冊帳戶。
3.2.1 您可以使用暱稱或化名;基本平台使用無需法定名稱,第 4.5 條規定的付款處理情況除外。
3.2.2 您有責任維護帳戶憑證的保密性,並對您帳戶下發生的所有活動負責。
3.2.3 您同意在法律要求時(例如為整合至平台的稅務或工資發放目的)提供準確、最新及完整的資訊,並更新該等資訊以保持準確。
3.3 準確性及誠實。 您陳述並保證您提供的所有資訊均真實準確。嚴禁假冒他人或實體。
3.4 禁止冒充機構。 未經我們事先書面許可,機構不得以僱主或家庭傭工身份在平台註冊、在平台預期渠道以外與家庭傭工建立聯繫、完整或部分恢復平台數據庫,或將平台用於任何與本條款不符的目的。

4. 資料控制、私隱及使用者內容

4.1 您的控制。 您控制您輸入的資料。我們的私隱政策詳細解釋我們收集什麼、為何收集以及如何管理。
4.2 家庭資料 – 私隱保障。
4.2.1 父母控制有關其家庭及子女的所有資訊。子女或長者無需提供真實姓名、確切出生日期或出生月份。父母可使用角色名稱、暱稱或化名。
4.2.2 年齡適當的報告表格(嬰兒、幼兒、學齡、青少年、長者)僅需出生年份。
4.2.3 醫療及特殊需要資訊完全屬自願性質。如不分享該等資訊,家庭傭工將不會收到,且 HK SafeKids 對因不披露該等資訊而產生的任何後果概不承擔任何責任。
4.2.4 家庭傭工只會收到父母選擇分享的內容。
4.3 家庭傭工資料。 家庭傭工控制其自身的專業資訊。家庭傭工決定其專業護照中包含哪些個人詳細資料、資格、工作經歷及推薦人。與家庭分享的資訊僅限於家庭傭工自願提供的內容。家庭傭工可隨時更新或刪除其資料,惟須受合法業務記錄保留(例如交易記錄、培訓記錄)所限。
4.4 機構資料。 機構控制其提供的有關其組織及其管理的家庭傭工的資訊。機構有責任在與家庭分享家庭傭工資料前取得必要的同意。
4.5 僅付款時需要真實姓名。 唯一需要真實法定姓名的情況是透過我們的第三方付款處理商 Stripe 在平台上進行或接收付款時。為符合付款閘道合規要求(反欺詐、認識你的客戶),付款方式上的姓名必須與使用者的法定姓名一致。對於所有其他平台功能(個人檔案、護理報告、通訊、護照),真實姓名屬自願提供。
4.6 父母責任。 HK SafeKids 不能替代父母責任。使用平台並不轉移或限制父母對其子女的照顧、安全、監督、醫療決定或福利的法律責任。父母必須授權及培訓家庭傭工執行任何委派的工作。
4.7 資料安全及付款。 我們不會出售個人資料。付款由 PCI 合規的第三方處理商 Stripe 安全處理;我們不會在伺服器上儲存信用卡資料。
4.8 內容許可。 透過上載內容,您授予 HK SafeKids 一項全球性、免版稅、非獨家的許可,僅為提供及改善平台而託管、儲存、複製、修改(為格式化目的)及展示該內容。您保留對內容的所有所有權。

5. 使用者責任及行為

5.1 所有使用者必須:合法、尊重及真誠地使用平台。不得騷擾、欺凌、威脅、假冒、歧視、剝削或傷害任何人。不得張貼、上載或傳輸任何非法、誹謗、淫褻、色情或其他具攻擊性的內容。不得試圖未經授權存取另一使用者的帳戶或本公司系統。不得使用平台發送垃圾郵件、網絡釣魚或散佈惡意軟件。未經我們事先書面同意,不得抓取、爬取、逆向工程或使用任何自動化方式存取平台或提取資料。
5.2 父母/家庭必須:在必要時向家庭傭工提供準確且充分的 safety 及醫療資訊,以確保安全護理。以尊嚴及尊重對待家庭傭工,並遵守所有有關休息、膳食、住宿、工資及工作時間的適用僱傭法律。不得要求非法工時、扣留工資或製造虐待性條件。在委派醫療或技術工作前,確保家庭傭工已獲適當授權及培訓。承認 HK SafeKids 是一項工具,最終的父母責任仍屬他們。
5.3 家庭傭工必須:提供有關資格、經驗及可用性的準確資訊。合法地並在其培訓及任何委派範圍內履行職責。尊重家庭私隱,未經許可不得在平台外披露家庭機密資訊。
5.4 機構必須:確保其註冊的家庭傭工獲授權工作,且提供的所有資訊均準確及經核實。在與家庭分享家庭傭工資料前取得所有必要同意。遵守所有適用的機構發牌及僱傭法律。不得促進或隱瞞任何剝削性或非法行為。

6. 對虐待及剝削的零容忍政策

6.1 HK SafeKids 對虐待、剝削、騷擾、威脅或任何危害家庭傭工或平台其他使用者的情況採取零容忍政策。
6.2 禁止行為包括但不限於:言語、身體或書面威脅或騷擾。盜竊工資、低於標準工資或非法扣留工資。提供不安全或不合法的住宿。要求違反適用僱傭法律的工作時間。任何形式的人口販運或強迫勞動。
6.3 舉報及執行。使用者可透過平台的舉報工具或電郵 info@hksafekids.com 舉報可疑虐待或違規行為。若我們收到可信報告或獲得該等濫用行為的證據,我們可全權酌情決定並在不承擔責任的情況下,立即暫停或終止違規使用者的帳戶。我們可為回應合法要求或為保護我們社群的安全,向適當執法或監管機構保存及披露相關日誌及資料。對於緊急或犯罪活動,我們鼓勵使用者首先聯絡當地緊急服務,然後通知 HK SafeKids。

7. 費用、付款、訂閱及退款

7.1 費用及訂閱。 平台的某些功能(如家庭傭工專業計劃、家庭計劃及機構計劃)需要支付費用。所有費用、訂閱條款及計費週期均在平台定價頁面上清楚顯示。訂閱會自動續期,直至您按照結帳時顯示的條款取消為止。
7.2 付款處理。 所有付款均由 Stripe 安全處理。透過提供付款資訊,您聲明您有權使用該付款方式,並授權我們(透過 Stripe)向您選擇的付款方式收取購買或訂閱的總金額。

8. 核實及篩查

8.1 使用者責任。 機構及父母全權負責在聘用或使用其服務前核實家庭傭工的身份、工作權利、資格及推薦人。
8.2 平台功能。 HK SafeKids 可能不時提供可選的核實功能(例如身份證核實、推薦人檢查)。使用此類功能須遵守附加條款。確認及任何檢查的充分性仍屬僱用方的唯一責任。HK SafeKids 不對任何已核實資訊的準確性或完整性作出任何陳述或保證。
8.3 不保證核實。 我們不核實列表、不保證結果,亦不干預就業流程。所有內容均由使用者產生,使用者有責任確保任何通訊、使用者分享的列表或安排符合當地勞工及入境法規。

9. 知識產權

9.1 平台所有權。 平台(包括其軟件、文字、圖形、標誌及認證框架)由 HK SafeKids(或其許可人)擁有,並受版權、商標及其他知識產權法律保護。未經我們事先書面同意,您不得使用我們的商標或品牌。
9.2 使用者內容所有權。 您保留對您內容的所有所有權。您授予我們第 4.8 條規定的許可。

10. 終止及暫停

11.4 家庭傭工責任及核實。使用本平台的家庭傭工確認及同意:(a) 所有培訓材料及護理標準僅為指引,不能取代專業培訓或資格;(b) 家庭傭工自行對其行為、表現及遵守所有適用法律及僱傭義務負全責;(c) HK SafeKids 不核實、保證或擔保任何家庭傭工或僱主的能力、適合性或可靠性;(d) 本平台上的「認證」是基於僱主對觀察到的工作場所能力的核實,並不構成任何形式的專業執照或法定資格。

12. 彌償

您同意賠償、辯護並使 HK SafeKids、其關聯公司及其各自的高級職員、董事、僱員及代理人免受任何及所有因以下情況引起或與之相關的申索、責任、損害賠償、損失、成本、開支或費用(包括合理的法律費用)的損害:(i) 您使用本平台;(ii) 您違反本條款;(iii) 您侵犯任何第三方權利,包括任何知識產權或私隱權;或 (iv) 您張貼或上載的任何內容。

13. 不可抗力

對於因超出我們合理控制範圍的原因(包括但不限於自然災害、戰爭、恐怖主義、騷亂、禁運、民事或軍事當局行為、火災、水災、意外、罷工、流行病、疫症、停電、互聯網服務供應商故障或任何政府或監管機構的行動)而導致的任何延遲或未能履約,我們概不承擔責任。

14. 電子通訊

您同意以電子方式(透過電郵、短訊或平台)接收我們的通訊。您同意我們以電子方式向您提供的所有協議、通知、披露及其他通訊均符合任何書面形式的法律要求。

15. 服務及條款的修改

15.1 服務演變。 HK SafeKids 不斷創新及改善其服務。我們保留在通知或不通知的情況下暫時或永久修改、暫停或終止平台任何部分的權利。我們不對您或任何第三方就任何修改、暫停或終止承擔責任。
15.2 條款變更。 我們可能不時修訂本條款。若我們作出重大變更,我們將在變更生效前透過電郵(發送至您帳戶中的電郵地址)或在本平台張貼通知通知您。在修訂條款生效日期後您繼續使用平台即構成您接受變更。如您不同意新條款,您必須停止使用平台。

16. 管轄法律及爭議解決

16.1 管轄法律。 本條款及任何因本條款引起或與之相關的爭議或申索,均受香港特別行政區法律管轄並據其解釋,不考慮其衝突法原則。
16.2 爭議解決 – 小額索償例外。任何一方可就爭議金額不超過該小額索償法院司法管轄權限額(香港通常為 75,000 港元)的爭議,向香港小額錢債審裁處(或對於居住在香港以外的使用者,向其居住國的同等小額索償法院)提出申索。未能在小額索償法院解決的任何爭議,應提交香港國際仲裁中心(HKIAC)並由其按照提交仲裁通知時有效的 HKIAC 機構仲裁規則最終以仲裁解決。仲裁地為香港。仲裁語言為英語。
16.3 地區適用性。 本條款適用於所有使用者,不論其所在地。使用者有責任遵守其當地法律。本第 16 條的任何規定均不阻止任何一方向任何具司法管轄權的法院尋求臨時強制令救濟。

17. 一般條款

17.1 完整協議。 本條款連同私隱政策及退款政策構成您與 HK SafeKids 之間就您使用平台所訂立的完整協議。
17.2 可分割性。 倘若本條款的任何條文被具司法管轄權的法院裁定為不可執行或無效,該條文應在最小範圍內予以限制或刪除,使其餘條款繼續具有完全效力。

HK SafeKids – Refund Policy / 退款政策

1. General Policy
HK SafeKids provides digital platform services, including subscription plans for Helpers (Helper Pro Plan), Families (Family Plan), and Agencies (Agency Plans). All fees paid to HK SafeKids are non‑refundable except as expressly provided below or as required by applicable law.

2. No Refunds for Subscriptions
Subscription fees are charged in advance for the applicable billing period. No refunds or credits will be issued for: Partial billing periods, Unused features or services, Early termination of a subscription. If you cancel your subscription during a billing period, your cancellation will take effect at the end of the current billing period. You will not receive a refund for the remaining portion of that period.

3. Limited Exceptions (As Required by Law)
3.1 Service Non‑Performance – If HK SafeKids fails to provide the core platform functionality as described and such failure is not remedied within fourteen (14) days of your written notice, you may request a pro‑rated refund for the affected period.
3.2 Duplicate Payment – If you are mistakenly charged twice for the same billing period, we will refund the duplicate charge upon verification.
3.3 Legal Requirements – Where required by applicable consumer protection laws in your jurisdiction (including but not limited to mandatory cooling‑off periods or rights for unsolicited services), we will process refunds in accordance with such laws. You are responsible for informing yourself of your local consumer rights.

4. No Cooling‑Off Period for Digital Services
Because our platform delivers digital content and services immediately upon subscription (e.g., access to training modules, daily reports, and dashboards), the statutory cooling‑off period that may apply to distance contracts does not apply where your local law exempts digital content once performance has begun. You acknowledge that by subscribing, you lose any right to cancel during a cooling‑off period once you access the platform’s features.

5. Free Trials
If you sign up for a free trial, you will not be charged until the free trial period expires. To avoid charges, you must cancel before the free trial ends. No refunds will be issued for charges incurred due to failure to cancel before the free trial period ends.

6. Payment Processing
All payments are processed by Stripe. Refunds, where issued, will be credited to the original payment method used for the purchase. Please allow up to fourteen (14) business days for the refund to appear in your account.

7. How to Request a Refund
To request a refund under the exceptions set out in Section 3, contact us at refunds@hksafekids.com within fourteen (14) days of the event giving rise to the refund request. You must provide: Your account information (email address), The date of the charge, The amount, A detailed explanation of why a refund is requested.

8. Disputes
If you believe a charge is incorrect, you must contact us within thirty (30) days of the charge. Failure to do so will constitute your acceptance of the charge.

9. Consumer Protection Rights
Nothing in this Refund Policy limits any rights you may have under applicable consumer protection laws in your jurisdiction (e.g., Malaysia’s Consumer Protection Act 1999, Singapore’s Consumer Protection (Fair Trading) Act, or Taiwan’s Consumer Protection Act). If any provision of this Refund Policy is found to be unenforceable under local law, that provision shall be interpreted or modified to the minimum extent necessary to comply with applicable law, and the remaining provisions shall remain in full force and effect.

10. Alignment with Terms of Service
This Refund Policy forms part of the HK SafeKids Terms of Service. In the event of any inconsistency, the Terms of Service shall prevail.

Helpers: professional information, employment history, references, etc. Parents/Families: family nickname, children info (nickname, year of birth, optional medical notes). Agencies: agency name, contact, billing details. 2.2 Information Collected Automatically – Usage Data, Device Data, Log Data, Cookies. 2.3 Information from Third Parties – Stripe, Agencies, References.

3. How We Use Your Information
To provide and maintain the Platform, improve and personalise your experience, communicate with you, process payments, verify information, ensure safety and security, comply with legal obligations.

4. How We Share Your Information
We do not sell your personal data. Sharing occurs: with other users (Helper Professional Passport, family/helper groups, agency dashboards), with service providers (Stripe, hosting providers), for legal and safety reasons, and in business transfers.

5. Your Choices and Controls
You can review, update, or correct your account information. You may request deletion of your account. You may opt out of marketing communications. Most browsers accept cookies but you can modify settings. We do not currently respond to “Do Not Track” signals.

6. Data Retention
We retain personal information as long as your account is active. Specific periods: Account data until deletion plus reasonable period; Transaction records 7 years; Training and certification records permanently; Daily reports and task logs as long as account active plus period for legitimate business purposes.

7. International Data Transfers
Your information may be transferred to, stored, and processed in Hong Kong, Singapore, Malaysia, Indonesia, or other countries where our service providers operate. By using the Platform, you consent to such transfers. We implement appropriate safeguards.

8. Security
We implement technical and organisational measures including encryption (SSL/TLS), secure data storage, regular assessments, access controls, and PCI compliance via Stripe. However, no method is 100% secure.

9. Children’s Privacy
Our Platform is designed for use by adults (18+). We do not knowingly collect personal information from children under 18. Parents control all information about their children.
