Welcome to HK SafeKids. These Terms of Service ("Terms") govern your access to and use of the HK SafeKids website, platform, and related services (collectively, the "Platform"). The Platform is operated by HK SafeKids ("Company", "we", "us", or "our").
By registering for or using the Platform, you ("User", "you") agree to be legally bound by these Terms. If you do not agree, you may not access or use the Platform.
1. Introduction & Purpose
1.1 HK SafeKids provides a digital ecosystem designed to support domestic helpers, families (parents/employers), and agencies through structured training, care planning, reporting, and professional development tools. Our goal is to improve safety, professionalism, and communication in the domestic work sector.
1.2 No Employment Agency. The Platform is an enabling service only. We are not an employment agency and we do not employ helpers. We are a technology platform that provides tools for training, scheduling, and communication.
1.2.1 Employment relationships, contracts, wages, working hours, accommodation, and all other legal obligations remain solely between the helper and the family/agency.
1.2.2 HK SafeKids is not a party to any employment contract and has no control over the quality, safety, or legality of any job posting, the truth or accuracy of any user content, or the ability of any user to perform their obligations.
2. Definitions
โ€ข "Helper": An individual providing or seeking to provide care or domestic services who uses the Platform.
โ€ข "Parent / Family": An individual or household using the Platform to manage care for children or dependents.
โ€ข "Agency": An organization that manages domestic helpers and/or facilitates placements between families and helpers on the Platform.
โ€ข "User": Any Helper, Parent/Family, or Agency.
โ€ข "Content": Any information, text, graphics, photos, profiles, reports, messages, or other materials you submit, post, or display on or via the Platform.
โ€ข "Professional Passport": A helper's public facing profile containing information they choose to share, including experience, skills, and certifications.
โ€ข "Certification Framework": Our three dimensional credentialing system (Operational, Developmental, and Specialist Care) which helpers can earn to demonstrate expertise.
3. Eligibility & Accounts
3.1 Age Requirement. You must be at least 18 years old to use the Platform.
3.2 Account Registration. To access certain features, you must register for an account.
3.2.1 You may use a nickname or pseudonym; a legal name is not required for basic Platform usage.
3.2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2.3 You agree to provide accurate, current, and complete information where legally required (e.g., for tax or payroll purposes integrated into the Platform) and to update such information to keep it accurate.
3.3 Accuracy and Honesty. You represent and warrant that all information you provide is truthful and accurate. Impersonation of another person or entity is strictly prohibited.
3.4 No Agency Impersonation. Agencies are prohibited from registering on the Platform as Employers or as Helpers without our prior written permission, establishing contact with Helpers outside the Platformโ€™s intended channels, fully or partially recovering the database from the Platform, or using the Platform for any purpose inconsistent with these Terms.
4. Data Control, Privacy & User Content
4.1 Your Control. You control the data you enter. Our Privacy Policy explains in detail what we collect, why, and how to manage it.
4.2 Family Data. Parents control all information about their family and children. Helpers receive only what parents choose to share.
4.2.1 Only a childโ€™s year of birth is required for age appropriate forms; other fields (e.g., medical notes, exact date of birth, names) are optional. The use of nicknames for children and family groups is fully supported.
4.2.2 Medical and special needs information is entirely optional. If such information is not shared, helpers will not receive it, and HK SafeKids disclaims all liability for any consequences arising from the non disclosure of this information.
4.3 Helper Data. Helpers control their own professional information. Helpers decide what personal details, qualifications, employment history, and references to include in their Professional Passport. Information shared with families is limited to what helpers voluntarily provide. Helpers may update or remove their information at any time, subject to legitimate business record retention (e.g., transaction history, training records).
4.4 Agency Data. Agencies control the information they provide about their organization and the helpers they manage. Agencies are responsible for obtaining necessary consents before sharing helper data with families.
4.5 Parental Responsibility. HK SafeKids is not a substitute for parental responsibility. Using the Platform does not transfer or limit parentsโ€™ legal responsibilities for the care, safety, supervision, medical decisions, or welfare of their children. Parents must authorize and train helpers for any delegated tasks.
4.6 Data Security & Payments. We do not sell personal data. Payments are processed by Stripe, a PCI compliant third party processor; we do not store credit card information on our servers.
4.7 Content License. By uploading Content, you grant HK SafeKids a worldwide, royalty free, non exclusive license to host, store, reproduce, modify (for formatting purposes), and display that Content solely to provide and improve the Platform. You retain all ownership rights to your Content.
5. User Responsibilities & Conduct
5.1 All Users must:
โ€ข Use the Platform lawfully, respectfully, and in good faith.
โ€ข Not harass, bully, threaten, impersonate, discriminate against, exploit, or harm any person.
โ€ข Not post, upload, or transmit any illegal, defamatory, obscene, pornographic, or otherwise offensive Content.
โ€ข Not attempt to gain unauthorized access to another userโ€™s account or Company systems.
โ€ข Not use the Platform to spam, phish, or distribute malware.
โ€ข Not scrape, crawl, reverse engineer, or use any automated means to access the Platform or extract data without our prior written consent.
5.2 Parents / Families must:
โ€ข Provide accurate and sufficient safety and medical information to helpers when necessary for safe care.
โ€ข Treat helpers with dignity and respect and comply with all applicable employment laws regarding rest, meals, accommodation, wages, and working hours.
โ€ข Not require unlawful hours, withhold wages, or create abusive conditions.
โ€ข Ensure helpers are properly authorized and trained before delegating medical or technical tasks.
โ€ข Acknowledge that HK SafeKids is a tool and that ultimate parental responsibility remains theirs.
5.3 Helpers must:
โ€ข Provide accurate information about qualifications, experience, and availability.
โ€ข Perform duties lawfully and within their training and any delegations given.
โ€ข Respect family privacy and not disclose confidential family information outside the Platform without permission.
5.4 Agencies must:
โ€ข Ensure helpers they register are authorized to work and that all information provided is accurate and verified.
โ€ข Obtain all necessary consents before sharing helper data with families.
โ€ข Comply with all applicable agency licensing and employment laws.
โ€ข Not facilitate or conceal any exploitative or unlawful practices.
6. Zero Tolerance Policy for Abuse and Exploitation
6.1 HK SafeKids has a zero tolerance policy for abuse, exploitation, harassment, threats, or any conditions that endanger helpers or any other users of the Platform.
6.2 Prohibited Conduct includes, but is not limited to:
โ€ข Verbal, physical, or written threats or harassment.
โ€ข Wage theft, underpayment, or illegal withholding of wages.
โ€ข Provision of unsafe or unlawful accommodation.
โ€ข Requiring work hours that violate applicable employment laws.
โ€ข Any form of human trafficking or forced labor.
6.3 Reporting and Enforcement.
โ€ข Users may report suspected abuse or violations via the Platformโ€™s reporting tools or by contacting us at info@hksafekids.com.
โ€ข If we receive a credible report or obtain evidence of such misuse, we may, in our sole discretion and without liability, immediately suspend or terminate the offending Userโ€™s account.
โ€ข We may preserve and disclose relevant logs and data to appropriate law enforcement or regulatory authorities in response to lawful requests or to protect the safety of our community.
โ€ข For urgent or criminal activity, we encourage users to contact local emergency services first, then notify HK SafeKids.
7. Fees, Payments, Subscriptions & Refunds
7.1 Fees and Subscriptions. Certain features of the Platform, such as the Helper Pro Plan, Family Plan, and Agency Plans, require payment of fees. All fees, subscription terms, and billing cycles are clearly displayed on the Platformโ€™s pricing page. Subscriptions automatically renew until cancelled in accordance with the terms presented at checkout.
7.2 Payment Processing. All payments are securely processed by Stripe. By providing payment information, you represent that you are authorized to use the payment method and authorize us (via Stripe) to charge your chosen payment method for the total amount of your purchase or subscription.
7.3 Price Changes. We reserve the right to change our fees or subscription plans at any time. We will provide users with prior notice of any material changes to fees. Your continued use of the Platform after the fee change becomes effective constitutes your agreement to pay the changed amount.
7.4 Refunds. All fees are non refundable except as expressly set out in our Refund Policy (which forms part of these Terms) or as required by applicable law. Unpaid fees may result in the immediate suspension or termination of your account and access to the Platform.
7.5 No Payment Transfers. Payments are strictly between the paying user (Helper, Parent, or Agency) and HK SafeKids. We do not facilitate the transfer of wages or other payments between families and helpers.
8. Verification & Screening
8.1 User Responsibility. Agencies and parents are solely responsible for verifying a helperโ€™s identity, right to work, qualifications, and references before hiring or engaging their services.
8.2 Platform Features. HK SafeKids may, from time to time, offer optional verification features (e.g., ID verification, reference checking). Use of such features is subject to additional terms. Confirmation and the adequacy of any checks remain the sole responsibility of the hiring party. HK SafeKids makes no representations or warranties regarding the accuracy or completeness of any verified information.
8.3 No Guarantee of Verification. We do not verify listings, guarantee outcomes, or intervene in employment processes. All Content is user generated, and users are responsible for ensuring that any communication, listings shared by users, or arrangements comply with local labour and immigration regulations.
9. Intellectual Property
9.1 Platform Ownership. The Platform, including its software, text, graphics, logos, and the Certification Framework, is owned by Mackenzie HanBridge Limited and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without our prior written consent.
9.2 User Content Ownership. You retain all ownership rights to your Content. You grant us the license set forth in Section 4.7 to use it.
9.3 Feedback. If you provide us with any suggestions, ideas, or feedback regarding the Platform, you grant us the right to use such feedback without any restriction or compensation to you.
10. Termination & Suspension
10.1 By User. You may delete your account or stop using the Platform at any time by following the instructions in your account settings or by contacting us.
10.2 By Company. We may suspend or terminate your access to the Platform, or delete your account, at any time for any reason, including but not limited to a breach of these Terms, illegal activity, or to protect other users. We will endeavor to provide you with notice unless we believe, in our sole discretion, that doing so would violate the law or cause harm to users or the Platform.
10.3 Effect of Termination. Upon termination, your right to access the Platform ceases immediately. We may retain records as required by law or for legitimate business purposes (e.g., transaction receipts, records required for safety investigations).
11. Disclaimers and Limitation of Liability
11.1 Platform โ€œAs Isโ€. THE PLATFORM IS PROVIDED ON AN โ€œAS ISโ€ AND โ€œAS AVAILABLEโ€ BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HK SAFEKIDS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT.
11.2 No Guarantees. We do not guarantee that the Platform will be uninterrupted, secure, or error free. We do not guarantee any specific outcomes, including but not limited to job placements, matches with families, or the conduct of any User.
11.3 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HK SAFEKIDS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE PLATFORM; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
11.4 Cap on Liability. OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL BE LIMITED TO THE TOTAL FEES PAID BY YOU TO HK SAFEKIDS DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR, IF YOU HAVE PAID NO FEES, THE SUM OF HK$1,000.00.
12. Indemnification
You agree to indemnify, defend, and hold harmless HK SafeKids, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneysโ€™ fees) arising from (i) your use of the Platform; (ii) your violation of these Terms; (iii) your violation of any third party right, including any intellectual property or privacy right; or (iv) any Content you post or upload.
13. Modification of Services and Terms
13.1 Evolving Services. HK SafeKids is constantly innovating and improving its services. We reserve the right to modify, suspend, or discontinue, temporarily or permanently, any part of the Platform, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance.
13.2 Changes to Terms. We may revise these Terms from time to time. If we make material changes, we will notify you by email (sent to the email address in your account) or by posting a notice on the Platform prior to the change becoming effective. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Platform.
14. Governing Law & Dispute Resolution
14.1 Governing Law. These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles.
14.2 Dispute Resolution. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the notice of arbitration is submitted. The seat of the arbitration shall be Hong Kong. The language of the arbitration shall be English.
15. General Provisions
15.1 Entire Agreement. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and HK SafeKids regarding your use of the Platform.
15.2 Severability. If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
15.3 Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
15.4 Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.

REFUND POLICY
HK SafeKids
Effective Date: 13/03/2026
1. General Policy
HK SafeKids offers digital platform services, including subscription plans for Helpers (Helper Pro Plan), Families (Family Plan), and Agencies (Agency Plans). All fees paid to HK SafeKids are non refundable except as expressly provided below or as required by applicable law.
2. No Refunds for Subscriptions
Subscription fees are charged in advance for the applicable billing period. No refunds or credits will be issued for partial billing periods, unused features, or early termination of a subscription. If you cancel your subscription during a billing period, your cancellation will take effect at the end of the current billing period, and you will not receive a refund for the remaining portion of that period.
3. Exceptions (As Required by Law)
Notwithstanding the foregoing, refunds may be issued only in the following circumstances:
3.1 Service Non Performance. If HK SafeKids fails to provide the core platform functionality as described and such failure is not remedied within fourteen (14) days of your written notice, you may request a pro rated refund for the affected period.
3.2 Duplicate Payment. If you are mistakenly charged twice for the same billing period, we will refund the duplicate charge upon verification.
3.3 Legal Requirements. Where required by applicable consumer protection laws in your jurisdiction (including, for users in Malaysia, the Consumer Protection Act 1999), we will process refunds in accordance with legal requirements. For Malaysian users, this means that if you cancel a subscription for future services that have not yet been provided, you may be entitled to a refund of the unused portion. We will honour such legal requirements.
4. Free Trials
If you sign up for a free trial, you will not be charged until the free trial period expires. To avoid charges, you must cancel before the free trial ends. No refunds will be issued for charges incurred due to failure to cancel before the free trial period ends.
5. Payment Processing
All payments are processed by Stripe. Refunds, where issued, will be credited to the original payment method used for the purchase. Please allow up to fourteen (14) business days for the refund to appear in your account.
6. How to Request a Refund
To request a refund under the exceptions set out in Section 3, contact us at refunds@hksafekids.com within fourteen (14) days of the event giving rise to the refund request. You must provide your account information, the date of the charge, the amount, and a detailed explanation of why a refund is requested.
7. Disputes
If you believe a charge is incorrect, you must contact us within thirty (30) days of the charge. Failure to do so will constitute your acceptance of the charge.
8. Consumer Protection Rights
Nothing in this Refund Policy limits any rights you may have under applicable consumer protection laws in your jurisdiction. If any provision of this Refund Policy is found to be unenforceable under local law, that provision shall be interpreted or modified to the minimum extent necessary to comply with applicable law, and the remaining provisions shall remain in full force and effect.

1. Who We Are
HK SafeKids is a technology company based in Hong Kong that provides a digital ecosystem for domestic helpers, families, and agencies. Our Platform includes tools for professional development (the Professional Passport and Certification Framework), daily care reporting, task management, and communication.
We are committed to protecting your personal data and being transparent about our practices. We comply with:

2.1 Information You Provide Directly
The types of information we collect depend on how you use the Platform and which user type you are.
User Type Information Collected Purpose
All Users Name (may be a nickname), email address, password, language preference, account settings. To create and manage your account, communicate with you, and provide customer support.
Helpers Professional information: country of origin, languages spoken, years of experience, preferred age groups, pet preferences, favorite aspects of the job, fun facts, professional certifications, employment history (employer names, dates, duties), references (name, relationship, contact info), self-ratings of soft skills (e.g., patience, communication), preferred rest day, and a profile photo (optional). To build your Professional Passport, match you with potential families/agencies, verify your experience, and provide personalized training recommendations.
Helpers (Paid) Payment information (processed by Stripe, not stored by us), training progress, completed courses, earned certificates, task logs. To process subscriptions, track your professional development, and certify your skills.
Parents / Families Family nickname, information about children (nickname, year of birth, optional medical notes, allergies, special needs, living environment), daily reports you submit, tasks assigned, and information about your helper. To create child profiles, generate age-appropriate daily report forms, manage care, communicate with helpers, and ensure child safety.
Agencies Agency name, contact information, billing details, lists of helpers and families you manage, and seat usage data. To manage your agency account, allocate helper seats, and provide reporting on helper training progress.
2.2 Information Collected Automatically
When you access or use the Platform, we may automatically collect:
โ€ข Usage Data: Your interactions with the Platform, such as pages visited, features used, time spent, and actions taken.
โ€ข Device Data: Information about your device, including IP address, browser type, operating system, device identifiers, and mobile network information.

If HK SafeKids is involved in a merger, acquisition, financing, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on the Platform of any change in ownership or uses of your data.
5. Your Choices and Controls
5.1 Account Information and Profile
You can review, update, or correct your account information at any time by logging into your account settings. Helpers can control what information is displayed on their public Professional Passport. Parents can control what information about their family is shared with helpers.
5.2 Deleting Your Account
You may request deletion of your account by contacting us at info@hksafekids.com. Upon verification, we will delete your account and personal information, subject to legal retention requirements (e.g., transaction records, records needed for safety investigations). Please note that deleting your account will remove your access to the Platform and may affect information shared with other users (e.g., training records linked to an agency).
5.3 Marketing Communications
You may opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails. You will continue to receive non promotional, account related communications (e.g., payment receipts, security alerts).
5.4 Cookies
Most web browsers are set to accept cookies by default. You can usually modify your browser settings to decline cookies. However, disabling cookies may affect your ability to use certain features of the Platform.
5.5 "Do Not Track" Signals
We do not currently respond to "Do Not Track" signals from web browsers. We await the development of a uniform standard for such signals.
6. Data Retention
We retain your personal information for as long as your account is active or as needed to provide you with the Platform. We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Specific retention periods:
โ€ข Account data: Until you delete your account (or we delete it for cause), plus a reasonable period thereafter to allow for backup and legal compliance.
โ€ข Transaction records: 7 years (to comply with tax and financial reporting laws).
โ€ข Training and certification records: Permanently (as they represent professional credentials you have earned, and we may need to verify them even after you stop using the Platform).
โ€ข Daily reports and task logs: As long as your account is active, plus a period thereafter as required for legitimate business purposes (e.g., responding to disputes).
7. International Data Transfers
HK SafeKids is based in Hong Kong. Your information may be transferred to, stored, and processed in Hong Kong, Singapore, Malaysia, or other countries where our service providers operate. These countries may have data protection laws that differ from those in your country of residence.
By using the Platform, you consent to the transfer of your information to countries outside your country of residence, including Hong Kong, which may have different data protection rules. We take steps to ensure that any international transfers comply with applicable laws and that your information is treated securely and in accordance with this Privacy Policy.
โ€ข For users in the European Union or the United Kingdom, we rely on appropriate safeguards (such as Standard Contractual Clauses approved by the European Commission) for transfers of personal data outside the European Economic Area.

9. Children's Privacy
Our Platform is designed for use by adults (18 years and older). We do not knowingly collect personal information from children under 18. The Platform allows parents to create profiles for their children, but we only collect the information parents choose to provide (such as a nickname and year of birth). Parents control all information about their children and can update or delete it at any time.
If you believe we may have inadvertently collected information from a child without proper parental consent, please contact us immediately at privacy@hksafekids.com and we will take steps to delete it.

10.1 Hong Kong PDPO Rights
Under the Hong Kong Personal Data (Privacy) Ordinance, you have the right to:
